Middletown Coke Company, a subsidiary of SunCoke Energy, Inc., is proposing to construct an electric cogeneration facility adjacent to a proposed coke manufacturing plant.  Waste heat from the coke ovens would pass through heat recovery steam generators, and the excess steam would drive a turbine at the cogeneration facility.  The facility would generate 57 MW on average with a maximum capacity of 67 MW, and would be connected to the Duke Energy transmission system through an on-site 13.8 kV to 69 kV substation.  The site is located within a planned industrial area in the city of Middletown, adjacent to an AK Steel manufacturing plant and other industrial properties.  The application was filed on June 6, 2008, and was certified as complete on July 22, 2008.  On September 26, 2008, the Staff Report was filed.  The local public hearing was held on October 14, 2008, and the adjudicatory hearing was held on November 7, 2008.  A joint stipulation and recommendation was filed on October 30, 2008.  This facility was approved by the Board on January 26, 2009.  An application for rehearing by the City of Monroe was denied by the Board on March 23, 2009.  The City of Monroe filed a Supreme Court appeal on May 22, 2009.
